Asturias Holiday Lettings
In Asturias holiday lettings are ruled by the general regulations of the Decreto 48/2016. However, there are also specific council regulations
This regulation is applicable to lettings that are offered professionally, (at least once a year) for temporary occupancy and not aimed to provide habitual residence. Holiday lettings are deemed as such when the letting is offered in the usual way to tourists via tourist agencies and websites of holiday accommodation and so on.

It distinguishes between Viviendas Vacacionales which refers to entire buildings, and Viviendas de Uso Turístico which refers to flats in a building that are also suitable to be rented by the room with no need for the host to be living there.

The building must comply with the regulations for a tourist activity, council regulations and all the rules relating to the tourist sector that may be applicable (disability access, fire and health safety, etc)

To start the activity a statement must be made before the competent authority of the Principado de Asturias which confirms all those requirements have been complied with and that the person responsible has the documents to prove it.

The letting activity can be started from the day the application is presented.

  • Viviendas Vacacionales
  • The law stipulates that a holiday house (vivienda vacacional), is an entire house which is regularly available to rent on a professional basis for a charge.
    Maximum capacity is 14 people with a maximum of 7 bedrooms.
    An official sign from the tourist authority must be displayed at the main entrance
    The following facilities and services are required:
    a) Hot and cold drinkable running water
    b) a sewage system
    c) electricity , with electric points in every room,
    d) rubbish collection
    e) heating
    f) a first aid kit
    g) a fire extinguisher on every floor
    h) telephone
    i) signed access with disabled access up to the entrance of the house
  • Bedrooms – doubles must be at least 10m², singles 6m², with natural light and ventilation, if opening onto a patio it must not be covered. An extra bed can be put in a double room if it is more than 3m larger than the minimum. Single beds must be at least 0.8m wide and doubles 1.35m wide. Bedrooms must be adequately furnished to an acceptable standards, with blinds or curtains for the windows and at least two sets of bedding supplied per week.
  • Bathrooms –for houses accommodating up to 6 people one bathroom is sufficient, with ventilation. It is permissible to have a shower instead of a bath.
  • Livingroom – must be at least 8m² or 1m² per person. Furniture must be in good condition.
  • Kitchen – must have ventilation and contain the usual fittings including fridge, oven, hob with at least 2 rings, washing-machine, iron and be fully equipped with cooking utensils, crockery, cutlery etc.
  • Viviendas de uso turístico
  • A vivienda de uso turístico is defined as an apartment within a block of apartments that is rented on a regular basis by the owner or agent for a fee. The entire apartment may be rented or individual rooms within the apartment, the owner is not obliged to live on the premises.
    The minimum size of rooms, number of bedrooms and corresponding number of occupants must comply with the regulations which will be specified by the tourist authority.
    An official sign with registration number from the tourist authority must be displayed outside.

    It must comply with the following requirements:
    a) to hold a certificate of fitness for habitation
    b) be sufficiently furnished and fully equipped with kitchen equipment, washing machine, crockery, bedding etc. appropriate to the number of people to be accommodated and to be maintained in a good condition and high level of cleanliness
    c) Have hot and cold drinkable running water
    d) Have an electricity supply
    e) Have heating
    f) Have a fire extinguisher
    g) Have emergency lighting
    h) Bedroom to have natural light and ventilation, if opening onto a patio it must not be covered and to supply curtains or blinds
    i) One bathroom is sufficient for accommodation for up to 6 people
